Terms and Conditions
The terms “karibu adventures,” “we” and “our” in this document refer to karibu adventures Inc. and its related and affiliated companies, including their employees, guides, contractors, shareholders, officers, directors, and agents. karibu adventures Inc. is an Alberta corporation, and travel retailer licenced in Alberta and carrying on business at Edmonton, licence no. 452269623-002, which offers all trips listed herein. All trips are offered subject to karibu adventures’ standard terms and conditions, which are agreed to online at time of booking. Please review the terms and conditions carefully prior to completing your reservation.
By booking a karibu adventures travel tour program (a “Program”) you acknowledge that you have read, understand, and agree to be bound by these Terms and Conditions (the “Terms”). If you make a booking on behalf of other participants, you represent and warrant to karibu adventures that you have the authority to accept and do accept these Terms on behalf of the other participants in your party.
1. THE BOOKING CONTRACT
Your booking is confirmed, and a contract exists when karibu adventures or your travel agent issues a written confirmation after receipt of the applicable deposit amount. Please check your confirmation carefully and report any incorrect or incomplete information to karibu adventures or your authorized agent immediately. While booking, please ensure that each traveller’s name is exactly as stated in the relevant passport.
You must be at least 18 years of age to make a booking. You agree to provide full, complete, and accurate information to karibu adventures.
2. BOOKING ON BEHALF OF OTHERS
By booking on behalf of other participants, you are deemed to be the designated contact person for every participant included on that booking. This means that you are responsible for making all payments due in connection with your Program booking, notifying karibu adventures or your travel agent if any changes or cancellations are required and keeping your party informed.
By booking on behalf of another person or persons, you represent and warrant that you have obtained all required consents. You are responsible for verifying that any information you provide on behalf of another participant is complete and accurate and karibu adventures will under no circumstances be liable for any errors or omissions in the information provided to complete a booking.
3. HEALTH AND REQUIRED MEDICAL INFORMATION
By sending a deposit toward your trip purchase and completing your Participation Agreement, you certify that you do not have any physical or mental condition or disability that would create a hazard for you or other travellers and that you have received all appropriate or necessary vaccinations as required by your country(ies) of destination. Please consult your doctor.
You must provide any medical information reasonably requested by karibu adventures.
karibu adventures may deny you permission to travel or participate in any aspect of a Program at any time and at your own risk and expense where karibu adventures determines, acting reasonably, that your physical or mental condition renders you unfit for travel or that you represent a danger to yourself or others.
You are responsible for assessing whether a Program is suitable for you. You should consult your physician to confirm your fitness for travel and participation in any planned activities. You should seek your physician’s advice on vaccinations and medical precautions. karibu adventures does not provide medical advice. It is your responsibility to assess the risks and requirements of each aspect of the Tour based on your own unique circumstances, limitations, fitness level and medical requirements.
Travel with karibu adventures may involve visiting remote or developing regions, where medical care may not be easily accessible and medical facilities may not meet the standards of those found in your home country. The condition of medical facilities in the countries you may visit on your Program varies and karibu adventures makes no representations and gives no warranties in relation to the availability or standard of medical facilities in those regions.
As a condition of participating on a karibu adventures trip, each traveller must be fully vaccinated according to the requirements of the country(ies) of destination at the time of travel. Each traveller shall also be responsible for carrying and providing to local authorities and service providers such proof of vaccination, proof of COVID-19 testing, proof of medical insurance and all other government-mandated forms required by local authorities in the country(ies) of destination. It is your responsibility to be aware of and to comply with all such requirements and laws. The rules change quickly and often – you must continue to inform yourself right up to and during your trip.
4. SPECIAL REQUIREMENTS
Any special requirements must be disclosed to karibu adventures at the time of booking. karibu adventures will use reasonable efforts to accommodate special requirements or requests but this is not always possible given the nature of the destinations visited and availability of options outside a planned itinerary. Certain activities may be inaccessible to you if your mobility is limited in any way. All food allergies and dietary restrictions must be disclosed to karibu adventures at the time of booking but karibu adventures does guarantee that dietary needs or restrictions can be accommodated. Any special requests or requirements do not form part of these Terms or the contract between you and karibu adventures and karibu adventures is not liable for any failure to accommodate or fulfill such requests.
5. AGE REQUIREMENTS
Anyone under the age of 18 years on the date of first travel is considered to be a minor. Minors must always be accompanied by an adult. One adult may accompany up to two minors. Unless otherwise indicated in the Program description or by karibu adventures, the minimum age for minors travelling on any prescheduled group Program is 12 years old, unless otherwise specified. There are no general age limitations on private trips although specific itineraries may have age-specific activities (such as kayaking).
All bookings including a minor are subject to review and approval by karibu adventures. If the consent of a parent, guardian or any other person is required by applicable law for any minor to travel, the accompanying adult is responsible for securing all consents, documentation and ensuring that they and the minor(s) meet all legal requirements to travel, to enter into and depart from applicable countries and regions. karibu adventures will not be responsible for any fees, damages, or losses incurred as a result of any failure to secure necessary consents, permits, and approvals.
Each adult on a booking with a minor or minor(s) is jointly and severally responsible for the behaviour, wellbeing, supervision, and monitoring of such minor(s), and jointly and severally accepts these Terms for and on behalf of any minor(s) on their booking, including all assumptions of risk and limitations of liability. karibu adventures does not provide care services for minors and expressly disclaims any responsibility for chaperoning or controlling any minor(s).
6. TRAVEL INSURANCE
Medical travel insurance is required to participate in our Programs. Your insurance plan should include full medical coverage, emergency evacuation and emergency repatriation. It is strongly advised that you extend your coverage to include Trip Cancellation and Interruption insurance that covers flight cancelations or delays, loss of luggage and personal effects, theft, and all other expenses that may arise as a result of loss, damage, injury, delay or inconvenience while traveling.
We will not allow you to participate in our trips without adequate travel insurance. You are required to add your travel insurance information to your booking by no later than 90 days prior to departure. If this information is not provided, we may cancel your booking and standard cancelation policies will apply.
You acknowledge that insurance coverage is not included in the cost of any Program offered by karibu adventures and you are required to obtain separate coverage at your additional cost. It is your responsibility to ensure that you have sufficient coverage and comply with the terms of the applicable insurance plans. You are responsible for advising your insurer of the type of travel, destination(s) and activities included in your booking so that the insurer may provide appropriate coverage.
7. VALIDITY
All dates, itineraries and prices of Programs are subject to change at any time and the current price will be quoted and confirmed at the time of booking, subject to any surcharges that may be levied in accordance with these Terms.
You acknowledge that you are responsible for keeping up to date on the specific details of your Program and any other products or services, including, but not limited to checking karibu adventures’ website up to 72 hours prior to departure as minor changes may have been made after the time of booking.
8. DEPOSITS
At the time of booking, a deposit of 50% of Program price, per person per Program is due to the karibu adventures. If the booking is made 90 days or less prior to departure, full payment is due at the time of booking.
Certain products or services offered by karibu adventures may require you to make full payment at the time of booking. karibu adventures will advise you of any such requirements prior to confirmation of the applicable booking.
9. FINAL PAYMENT & ACCEPTANCE OF BOOKING
Payment of the outstanding balance of the price for any Program is due 90 days before the departure date of the first Program included in the applicable booking. If full payment is not received by the applicable due date, karibu adventures may, at its sole discretion, change the price payable for the booking, or treat the booking as cancelled and retain the deposit and any other funds paid as forfeited. If, for any Program booked, payment terms differ from those outlined in this section, the applicable terms will be communicated to you prior to booking and will also be detailed on the applicable invoice.
karibu adventures is not responsible for any charges levied by third parties or financial institutions and payable by you as a result of credit card or other payment transactions and will not refund or return any fees charged by third parties or financial institutions in connection with payments made by you to karibu adventures.
We accept electronic transfer payments and most credit cards for deposit and trip balance payments.
10. PAY IN FULL, LOCK IN YOUR RATE
We may publish our prices more than a year in advance. Between that time and the time of your Program’s departure, we are occasionally faced with cost increases (e.g., foreign currency fluctuations, fuel surcharges, increases in cost of services). In the event of a significant change in costs, we reserve the right to apply a surcharge. If you pay in full at the time of booking, you are exempt from any such surcharges.
From time-to-time karibu adventures may offer reduced pricing on certain products or services. Reduced pricing applies only to new bookings. Bookings where payment of at least a deposit has been received by karibu adventures are not eligible for reduced pricing.
11. DETAILS REQUIRED FOR BOOKING
As a condition of booking, you must provide the information requested by karibu adventures along with deposit. If you fail to supply information required by karibu adventures for permits, hotels, or other inclusions, you will also be liable for any costs, fees or losses including failure to obtain or provide that inclusion. In the event that you fail to supply information required by karibu adventures, karibu adventures also reserves the right to treat your booking (or the relevant component of your booking) as cancelled and levy any cancellation fees deemed reasonable by karibu adventures, in its sole discretion. The information required by karibu adventures will vary by Program and will be communicated to you or to karibu adventures’ authorized agent during the booking process. karibu adventures is not responsible for any fees you incur as a result of errors, omissions, inaccuracies, late, misplaced or otherwise incomplete information you have provided.
12. AIRFARE
Program prices do not include international or other airfare unless expressly identified by karibu adventures in the Program’s descriptions. karibu adventures will quote airfare the best price available for the travel dates requested at the time the quote is prepared. Quotes provide an estimate only and are not a firm price commitment by karibu adventures or the applicable air carrier(s).
karibu adventures acts only as a sales agent for the applicable air carrier and the air carrier terms and conditions apply to the purchase and use of air travel tickets. Please consult the air carrier’s applicable terms and conditions and conditions of carriage for complete information including applicable cancellation terms. karibu adventures is not responsible for changes in air itineraries or flight times and does not provide advice or alerts regarding air travel tickets, flight status or delays.
13. CANCELLATION
The following conditions apply, depending on whether a cancelation is made “by you,” “by us,” or “by force majeure”:
CANCELLATION BY YOU
You may cancel your booking by notifying karibu adventures. Cancellation fees, if any, will be determined with reference to the date on which notice of cancellation is received by karibu adventures and are expressed as a percentage of the total price of the cancelled Program, product, or service (excluding any insurance products).
Cancellation of a Program:
Cancellation 100 days or more before Program departure: Full Program payment will be refunded, less third-party credit card and booking fees.

Cancellation 100 days before trip departure: No refund applies.
A cancelation by you will take effect from the date we receive notice in writing. No refunds will be provided in the event of voluntary or involuntary early departure from a trip. No refunds will be given for missed or unused services including, but not limited to, accommodation, activities, and meals. We strongly recommend travel insurance which covers cancelation.
CANCELLATION OF A PROGRAM BY US
We are occasionally required to cancel a trip at any time prior to departure for reasons beyond our control, including when the minimum number of guests required to operate a trip is not reached. If your trip is canceled, you are welcome to transfer to an alternate departure for no additional fee, or transfer to an alternative trip (subject to any difference in price) or opt for a full refund.
karibu adventures reserves the right to cancel any scheduled trip at any time for any reason determined in our sole discretion.
BY FORCE MAJEURE
karibu adventures will not be liable in any way for death, bodily injury, illness, emotional distress or injury, damage, delay or other loss or detriment to person or property, or financial costs both directly and indirectly incurred, or for karibu adventures failure to commence, perform or complete any duty owed to you, including any Program or part thereof (collectively, a “Loss”), if Loss is caused by any event beyond the control of karibu adventures, including but not limited to any natural events, acts of God, war or war like operations, mechanical breakdowns, terrorist activities or threat thereof, civil commotions, labor difficulties, interference by authorities, political disturbance, howsoever and where so ever any of the same may arise or be caused, riot, insurrection and government restraint, fire, extreme weather, significant risks to human health such as the outbreak of serious disease including any mutation or variation of, and the ongoing effects of, Covid-19 or SARs-COV2, or any other cause whatsoever that would, in the reasonable opinion of karibu adventures, make it dangerous or not viable for a Program to commence or continue, any and all of which events, individually and collectively, constitute “Force Majeure”.
In circumstances where a cancelation is necessary before a trip commences due to Force Majeure, karibu adventures may endeavor to transfer your booking to an alternative departure or Program or offer a credit to use towards the balance of any new booking.
If a cancellation due to Force Majeure or a suspension of operations by karibu adventures occurs after the Program has commenced, karibu adventures, at its option, may offer you either a pro-rata:
(a) travel credit valued at 100% of the monies paid for the days that remain on your Program; or
(b) refund minus unrecoverable costs of the days that remain on your Program.
All credits and refunds resulting from cancelation for any reason will be net of any non-refundable expenses incurred by us. If your booking is changed or transferred for any reason, the Terms in effect on the date your new booking is made will apply. karibu adventures is not responsible for any additional expenses you may incur as a result of your booking being canceled or changed including, but not limited to, expenses related to visas, vaccinations, medical expenses, clothing, equipment, testing, quarantine, travel insurance excess or flights, loss of earnings, or loss of enjoyment.
14. CHANGE OF TRIP OR DEPARTURE DATE
You are welcome to change your Program and/or departure date, subject to availability, at any time prior to 90 days before the departure date of your booked Program. The following conditions apply:
First change (Program and/or departure): No charge
Second and subsequent changes: $250 per guest per change
New Program pricing (where applicable) will apply for all changes
A change of Program and/or departure will take effect from the date we receive notice in writing. We strongly recommend travel insurance which covers cancelation and change penalties.
Credits and refunds resulting from a change of Program and/or departure for any reason will be net of any non-refundable expenses incurred by us. If your booking is changed or transferred for any reason, the booking Terms in effect on the date your new booking is made will apply. karibu adventures is not responsible for any additional expenses you may incur as a result of your booking being changed including, but not limited to, expenses related to visas, vaccinations, medical expenses, clothing, equipment, testing, quarantine, travel insurance excess or flights, loss of earnings, or loss of enjoyment.
Changes made by karibu adventures: karibu adventures may modify your Program itinerary where reasonably required in its sole discretion. If karibu adventures makes a change affecting at least one in three full days of the itinerary or which materially affects the character of a product or service in its entirety (a “Material Change”), karibu adventures will provide notice to you as soon as reasonably possible, provided that there is sufficient time to do so before departure. If a Material Change is made more than 14 days before departure, you may choose to:
i) accept the Material Change and proceed with the amended Program;
ii) book another Program of equal or greater value, if available (you will be responsible for paying any difference in price); or
iii) book another Program of lesser value, if available (with a refund payable to you for the difference in price); or
iv) cancel the amended Program and receive a full refund for the land-only portion of the applicable Program (except as otherwise provided in these Terms, a refund is not available for Programs booked which are not subject to a Material Change).
You must notify karibu adventures of your choice within 7 days of receiving notice or you will be deemed to accept the amended itinerary.
Once a Program has departed, itinerary changes may be necessary as a result of unforeseen circumstances, operational concerns, or concerns for your health, safety, enjoyment, or comfort. Any changes are at the discretion of karibu adventures.
You acknowledge that you must have reasonable financial resources to cover incidental expenses during all travel with karibu adventures, whether or not such expenses arise from a change of itinerary, and karibu adventures is not liable for your failure to prepare adequately for travel and unforeseen circumstances which may arise during travel. karibu adventures is not liable for any indirect and or consequential losses associated with any changes to a Program or itinerary.
15. FLEXIBILITY & UNUSED SERVICES
You acknowledge that the nature of adventure travel requires flexibility and that you will permit reasonable alterations to products, services, or itineraries by karibu adventures. The route, schedules, accommodations, activities, amenities, and mode of transportation are subject to change without notice due to unforeseeable circumstances or events outside the control of karibu adventures (including but not limited to Force Majeure, mechanical breakdown, flight cancellations, strikes, political events and entry or border difficulties). No reimbursements, discounts or refunds will be issued for services that are missed or unused after departure due to no fault of karibu adventures, including your removal from a Program because of your negligence or breach of these Terms.
16. TRAVEL DOCUMENTS
It is your responsibility to obtain and to have in your possession all the required documentation and identification required for entry, departure and travel to each country or region. This includes a valid passport and all travel documents required by the relevant governmental authorities including all visas, permits and certificates (including but not limited to vaccination or medical certificates), proof of COVID-19 testing and insurance policies. You must have a passport that is valid 6 months after the last date of travel with karibu adventures as set out on your itinerary. You accept full responsibility for obtaining all such documents, visas and permits prior to the start of the Program, and you are solely responsible for the full amount of costs incurred as a result of missing or defective documentation. You agree that you are responsible for the full amount of any loss or expense incurred by karibu adventures that is a direct result of your failure to secure or be in possession of proper travel documentation. karibu adventures does not provide advice on travel documents and makes no representations or warrantees as to the accuracy or completeness of any information provided regarding visas, vaccinations, climate, clothing, baggage, or special equipment and you agree that karibu adventures is not responsible for any errors or omissions in this information.
17. ACCEPTANCE OF RISK
You acknowledge that adventure travel and the products and services offered by karibu adventures may involve a significant amount of risk to your health and safety. By traveling with karibu adventures you acknowledge that you have considered any potential risks to your health and safety and that of others in your party.
You acknowledge that the degree and nature of personal risk involved depends on the products or services booked and the location(s) in which your Program takes place, and that there may be a significant degree of personal risk involved in participating, particularly participating in physical activities, travel to remote locations, carriage by watercraft, participation in “extreme sports” or other high-risk activities, or travel to countries with developing infrastructure.
Standards of hygiene, accommodation, and transport in certain countries where Tours take place are often lower than the standards you may reasonably expect in your home country or region. You agree that karibu adventures is not responsible for providing information or guidance with respect to local customs, weather conditions, specific safety concerns, physical challenges, or laws in effect in any locations where a Program, product or service is operated. You acknowledge you have considered the potential risks, dangers and challenges and your own personal capabilities and needs, and you expressly assume the risks associated with travel under such conditions.
Risks related to travel also include the likely presence of the virus that causes COVID-19, including variants (collectively “COVID-19”). Rates of COVID-19 infection may be higher, and rates of vaccination may be lower at the locations of your Trip than in your home state or country, and that the sophistication and availability of therapies, medical practitioners, and hospital beds for treatment of COVID-19 may be significantly impaired. Laws, regulations, customs, and policies related to COVID-19 in the destinations and premises where you will travel on Trip may be different than in your home country.
You must at all times strictly comply with all applicable laws and regulations of all countries and regions in which any part of the Program takes place. Should you fail to comply with the above or commit any illegal act when on Program or, if in the opinion of karibu adventures (acting reasonably), your behavior is causing or is likely to cause danger, distress or material annoyance to others, karibu adventures may terminate your travel arrangements on any product or service immediately at your expense and without any liability on karibu adventures’ part. You will not be entitled to any refund for unused or missed services or costs incurred as a result of termination of your travel arrangements, including, without limitation, return travel, accommodations, meals, and incidentals.
You are responsible for any costs (including repair, replacement, and cleaning fees) incurred by karibu adventures or karibu adventures’ suppliers for property damage, destruction or theft caused by you while on a Program. You agree to immediately report any pre-existing damage to a representative of karibu adventures and staff of the accommodation, transportation service, or facility as soon as possible upon discovery.
You agree to take all prudent measures in relation to your own safety while on Program including, but not limited to, the proper use of safety devices (including seatbelts, harnesses, flotation devices and helmets) and obeying all posted signs and oral or written warnings regarding health and safety. Neither karibu adventures nor its Third-Party Suppliers (as defined below) are liable for loss or damages caused by your failure to comply with safety instructions or warnings.
You hereby assume responsibility for all such risks and release karibu adventures from all claims and causes of action arising from any loss resulting from risks inherent in travel, including adventure travel specifically, visiting foreign destinations, and participating in adventurous activities such as those included in Program itineraries or otherwise offered by karibu adventures. karibu adventures requires that you confirm your assumption of this responsibility by completing the participation agreement (the “Agreement”) prior to departing on your Program.
You agree to bring any complaints to karibu adventures as soon as possible in order to provide karibu adventures with the opportunity to properly address such complaint. You agree to inform your Program guide, another representative of karibu adventures or karibu adventures’ customer service department directly. karibu adventures assumes no liability for complaints that are not properly brought to the attention of karibu adventures and cannot resolve or attempt to resolve complaints until proper notice is provided. Any complaint made after the completion of a Program must be received in writing by karibu adventures within 30 days of the last day of travel of the booking in question.
18. KARIBU ADVENTURES IS NOT LIABLE FOR THIRD PARTY SUPPLIERS
karibu adventures makes arrangements with accommodation providers, activity providers, airlines, coach companies, transfer operators, shore excursion operators, tour and local guides, lodging, restaurants, and other independent parties (“Third Party Suppliers”) to provide you with some or all of the components of your Program. Third Party Suppliers may also engage the services of local operators and sub-contractors. Although karibu adventures takes all reasonable care in selecting Third Party Suppliers, karibu adventures is unable to control Third Party Suppliers, does not supervise Third Party Suppliers and therefore is not responsible for their acts or omissions. Any services provided by Third Party Suppliers are subject to the terms and conditions imposed by these Third-Party Suppliers and their liability is limited by their tariffs, conditions of carriage, tickets and vouchers and international conventions and agreements that govern the provision of their services. These may limit or exclude liability of the Third-Party Supplier. You acknowledge that Third Party Suppliers operate in compliance with the applicable laws of the countries in which they operate and karibu adventures does not warrant that any Third-Party Supplier is in compliance with the laws of your country of residence or any other jurisdiction.
karibu adventures is not liable and will not assume responsibility for any Loss resulting from the act or omission of any party other than karibu adventures and its employees.
karibu adventures is not liable for the acts or omissions, whether negligent or otherwise, of Third-Party Suppliers or any independent contractors.
19. OPTIONAL EXTRAS
“Optional Extras” refers to any activity, transportation, meal, product, or service not expressly included in the Program itinerary or price of the Program, and which does not form part of the Program. You agree that any assistance given by karibu adventures’ representative(s) in arranging, selecting, or booking, any Optional Extras is purely at your request and karibu adventures makes no warranties and expressly disclaims any liability whatsoever arising from participation in Optional Extras or any information provided by any representative of karibu adventures regarding any Optional Extras. You release karibu adventures from all Loss related to or arising from participation in or booking of Optional Extras.
You acknowledge and agree that any liability Loss associated with Optional Extras is the sole responsibility of the third party providing that service or activity and you will only seek recovery for such Loss from that party.
20. ADDITIONAL LIMITATIONS
In the event that any Loss is caused by the negligent acts or omissions of karibu adventures or of the Third-Party Suppliers of any services which form part of the booking contract then karibu adventures limits its liability, where applicable by all applicable international conventions.
Notwithstanding anything to the contrary elsewhere in these Terms, karibu adventures will not in any circumstances be liable to you for any loss or anticipated loss of profit, loss of enjoyment, loss of revenue, loss of use, loss of contract or other opportunity nor for any other consequential or indirect loss or damage of a similar nature.
For claims not involving personal injury, death, or illness or which are not subject to the Conventions referred to above, any liability karibu adventures may incur for the negligent acts or omissions of its suppliers is limited to a maximum of the price which you paid for the applicable Program, not including insurance premiums and administration charges. Where this relates to loss or damage to luggage and other personal possessions then karibu adventures liability will not exceed $1,000 CAD. karibu adventures will not at any time be liable for any loss of or damage to valuables of any nature. You agree that you will be precluded from making a double recovery by making the same claims and seeking recovery against karibu adventures and its suppliers, contractors or other third parties including your insurer.
21. IMAGES AND MARKETING
You agree that, while participating in any Program, images, photos, or videos may be taken by other participants, karibu adventures or its representatives that may contain or feature you or your likeness. You consent to any such pictures being taken and grant a perpetual, royalty-free, worldwide, irrevocable license to karibu adventures, its contractors, sub-contractors and assigns, to reproduce for any purpose whatsoever (including marketing, promotions and the creation of promotional materials by or with sub-licensees), in any medium whatsoever, whether currently known or hereinafter devised, without any further obligation or compensation payable to you.
22. PRIVACY POLICY
karibu adventures must collect your personal information to deliver the Program and any products or services booked. karibu adventures collects, uses, and discloses only that information reasonably required to enable karibu adventures and its Third-Party Suppliers to provide the particular Program, products and services that you have requested as described in karibu adventures’ Privacy Policy, which can be accessed any time on the website and is expressly incorporated into these Terms. By submitting any personal information to karibu adventures, you indicate your acceptance of karibu adventures’ Privacy Policy.
23. SEVERABILITY
If any provision of these Terms is determined by a court of competent jurisdiction to be so broad as to be unenforceable, such provision will be interpreted to be only so broadly as is enforceable. The invalidity or unenforceability of any provision hereof will in no way affect the validity or enforceability of any other provision.
24. CONTRACT PARTIES & SUCCESSORS
These Terms will inure to the benefit of and be binding upon the parties and their respective heirs, legal and personal representatives, executors, estate trustees, successors, and assigns.
25. APPLICABLE LAW
The Contract and these Terms are subject to the laws of Alberta, Canada and you submit to the exclusive jurisdiction of the courts located in Edmonton, Alberta, Canada for the resolution of any dispute under these Terms or concerning any Program, product, or service.
26. AMENDMENTS
karibu adventures reserves the right to update or alter these Terms at any time and will post the amended Terms on karibu adventures’ website. Any amendment will take effect 10 days after being posted to karibu adventures’ website. An up-to-date copy of these Terms, as amended, may be accessed at any time on karibu adventures’ website and will be sent to you upon written request to karibu adventures. You are deemed to have accepted any amendments to these Terms on the date that is 10 days after their posting on karibu adventures’ website. karibu adventures recommends that you refer to the Terms prior to travel to familiarize yourself with the most up-to-date version available.
